Inheritance and estate tax in Maine
Maine imposes a state-level estate tax with an exemption below the federal threshold, meaning an estate can owe Maine tax while owing no federal estate tax at all. The tax is generally paid by the estate before assets are distributed to heirs.
Stepped-up basis — the rule most heirs never hear about
Inherited assets generally receive a "stepped-up" cost basis: they are revalued to fair market value as of the date of death. In practice, this often means an inherited investment or property can be sold shortly after inheriting it with little or no capital gains tax, regardless of how much it appreciated during the original owner's lifetime. Heirs who assume they will owe tax on decades of growth frequently hold assets they would rather sell.
The inherited IRA 10-year rule
Under the SECURE Act framework, most non-spouse beneficiaries must fully withdraw an inherited retirement account within 10 years. How those withdrawals are spread across that window materially changes the total tax paid, because each distribution is generally ordinary income. Taking the full balance in a single year can push a beneficiary into a substantially higher bracket than a planned multi-year drawdown.
